Subject: Can I accept gas money?



Now, as a former guide (who may or may not be under the scrutiny of the CG), can I accept gas money if I take someone fishing with me?

Does it matter that I no longer carry a guides license?

Does it matter how long or how well I know my fishing partner for the day?

Am I personally held to a tighter standard in the receiving of gas money by my fishing partner due to the fact that I am a known perosn who is compensated for my published fishing knowledge?

Why not? If two friends go fishing, why shouldn't they share expenses? I take friends, or go with friends, all the time. We always share expenses. Nothing wrong with that. I'm not profitting from it. ANd I don't consider it guiding. How long does one have to know another to consider themselves friends?

Call your local coast guard unit... they are the ones that are going to enforce the rules (or not). Then call your State Rep. and Senator if you don't like the answer you get.

When I take someone fishing that does not have a boat, (and therefore does not take me), I will except gas money if they offer. If I go with a buddy with a boat, I will not take any but also don't offer when I ride with them. Just comes out as a "wash".

Good questions Doc! Personally I always offer to pay for gas but never ask that someone "contributes" As far as I'm concerned it's friends taking friends fishing but if you ask someone to share expenses with you it is considered payment for services as I understand it and hence you are required to have a guides license! Don't take my word for it though because as many here know me and some will say I don't know what the he double hockey sticks I'm talking about.

I suspect that the one who owns the boat can't ask for gas money or make the fishing trip contingent upon it.

But if you make it clear you are NOT a fishing guide, and your friend insists by putting money in your pocket, there is not a judge in the land that would construe this as an illegal fishing trip.

This is what I'm getting at. I've been told that even accepting breakfast is considered breaking the law. Good points have been made. One, is the trip dependant upon the non-boat owner chipping in for gas? Sometimes even close friends make sure that costs are going to get split, right? Supposed to offer the PWT Pro you're fishing with to split gas right? (or has that changed)
Well, if a guy wants to buy me breakfast, a steak, 3 cocktails, chip in for gas, send me a birthday present, christmas present or name a child after me that's up to him. I just want to go fishing and meet some of the people who visit my website OR have bought my walleye CD and if I have to stand before the man because of some STUPID rule, then that I will.

I agree with you Doc We have the same problem on the Mississippi,plus the Feds are charging a $120.00 "user fee" in addition to the Captians Lic.Anybody want to pay $200.00 for a beer and I'll take you fishing for a day for free.Since all this has started to happen I have stopped guiding and when we sell the Bar I will go to the classes and get the Lic. and my rates will increase.That is the way that it will have to be.These old laws need to be changed or new regulations need to be adopted to serve this type of guiding.In my opinion this is just another way for the FEDS to make more money,and for the guides that can not afford to take the time or spend the money for the tests it is to bad.More than likely some of that money was used to pay the extra bills or by the kids some nice x-mas presents and that is the real sad thing about.

You know I can understand your situation Len but the "navagable to the ocean" part of the rule surely applies to your waterway so they got you by the short hairs. Do I think you should have to have a captains license to guide 2 or 3 people in a 17 foot boat on the Mississippi? Probably not although I DO feel that it should be more difficult then just paying $40.....here too. I can see a written exam and proof of a seaworthy boat and time on the water, but $100's of dollars and on and on are WAY beyond what it should be. Again, maybe not on Winnebago itself or even the Mississippi due to their sheer size but if the "rule" depends on navagability to the ocean then lets see them get their boat from the Bay of Green Bay to Lake Winnebago without using a trailer. And if THAT constitutes navagability to the ocean, then every waterway on the planet applies.

Selling the bar? I'll be on my way over soon for a steak and some fishing, you're still my favorite cook!!
